Thomas handles a wide range of building disputes, from the pre-contract phase all the way through to practical completion and beyond.
He represents owners, builders, subcontractors, trade contractors, and industry suppliers in various building disputes, excluding WorkCover claims, WHSQ prosecutions, and planning & environment matters.
The building disputes Thomas works on are diverse and include:
- Providing pre-contract advice to owners to ensure that their building contracts are well-drafted and clearly explained before signing.
- Advising owners on issues such as claims for incomplete or defective work, delay costs, and claims under the QBCC’s Home Warranty Insurance Scheme.
- Offering guidance to builders and startups, particularly on legislative requirements under the Queensland Building and Construction Commission Act, Australian Consumer Law, the Fair Work Act, the Corporations Act, and the Queensland Civil & Administrative Tribunal Act.
- Assisting builders with contractual issues, including progress payments, liquidated damages, disputes over incomplete or defective work, delay costs, and actions under the Building and Construction Industry Payments legislation.
- Making and responding to claims under the Subcontractors’ Charges legislation.
- Representing clients in all Queensland courts, preparing applications, responses, and statements for the Queensland Civil & Administrative Tribunal.
- Representing clients at mediations, settlement conferences, and directions hearings.
Thomas also advises building businesses, suppliers, and employees on matters such as applications to the Fair Work Commission, audits and investigations by the Fair Work Commission, general debt recovery, cash flow and insolvency issues, and protection against non-payment or insolvency events (including obtaining and enforcing securities under the Personal Property Securities Act).
