Thomas represents beneficiaries, executors, trustees, and others involved in the following types of disputes:
- Beneficiaries (or potential beneficiaries) who feel they haven’t been properly provided for in a deceased person’s Will or estate. These are called “family provision” claims.
- Disputes between trustees or between a trustee and a beneficiary about how a testamentary trust is being managed, or mismanaged.
- Disagreements over the meaning of a Will or other testamentary documents.
- Contesting a Will or challenging a claim that a Will is fraudulent, or that it should be set aside due to undue influence or lack of mental capacity.
- Filing caveats in the Supreme Court of Queensland to stop probate from being granted until a dispute is settled by the Court.
As with many legal matters, strict time limits apply to estate disputes, so it’s important to seek advice on your rights as soon as possible.
